Yes. As a matter of law in Pennsylvania, all District Justice judgments are appealable as a matter of right, regardless of a legal reason for appeal. A tenant who wishes to stay must pay either 3 months rent or the actual rent in arrears to the Court in order for an appeal to act as a supersedeas (a stay on the possession part of judgment). Such an appeal must be brought within 10 days of judgment. A tenant may appeal the money portion of the judgment for up to 30 days from the date of judgment.
