What are the Residency and Filing Requirements for Divorce in West Virginia?

In West Virginia, Family Courts have jurisdiction over divorce proceedings. (West Virginia Code Chapter 48 Domestic Relations Article 5 Divorce  Section 102)  Residency is established if the couple was married in West Virginia and one of the spouses lives in West Virginia, regardless of the amount of time of that residency.  Residency may also be established if the cause of the divorce arose in West Virginia and one of the parties has maintained a bona fide residence in state for at least one year. (West Virginia Code Chapter 48 Domestic Relations Article 5 Divorce  Section 105)
