What recourse does an employee have under North Carolina law if he or she is unable to obtain his or her final paycheck from a former employer?

If an employee is unable to obtain his or her final paycheck from a former employer within ten (10) days following the date of discharge, and the amount of the final paycheck is in excess of $50.00, the employee can file a wage complaint with the North Carolina Department of Labor, Wage and Hour Bureau.
