Unless an injury either renders the employee physically or mentally unable to do so, or is made known to the employer immediately after it occurs, the employee shall report the injury to the employer on a form prescribed or approved by the Workers` Compensation Commission. The employer shall not be responsible for disability, medical, or other benefits prior to receipt of the employee`s report of injury.
A claim for compensation for disability on account of an injury, other than an occupational disease and occupational infection, shall not be allowed unless filed with the commission within two years from the date of the work related injury. If, during the twoyear period following the filing of the claim, the injured employee receives no weekly benefit compensation and receives no medical treatment resulting from the alleged injury, the claim shall be denied thereafter.

When the employee selects a physician, the commission shall not authorize a change of physician unless the employee first establishes to the satisfaction of the Workers` Compensation Commission that there is a convincing reason or circumstance justifying a change.
If the employer selects a physician, the claimant may petition the Workers` Compensation Commission one time only for a change of physician.
At times, the employer and or the Workers` Compensation Commission may require you to submit to a physical examination another qualified physician, designated or approved by the commission. If you refuse to participate in this examination, you may lose your right to further compensation.

If your employer has employment available to you within your medical restrictions and you decline, your employer may request a modification or termination of your benefits. If you do return to work and wages are less than what you earned before the injury, you may be entitled to partial disability. Wage benefits usually will equal approximately 662/3 of the difference between your current earnings and what you earned before your injury, not exceeding the maximum compensation rate for the year you were injured.

The Workers` Compensation Commission can provide the claimant an opportunity to confer with a legal advisor on the staff of the commission to be advised of their rights in order to ensure that the rights are protected. The conference shall be held in the county where the accident occurred, if the accident occurred in this state, unless otherwise agreed to between the parties, or otherwise directed by the commission.

This is meant to provide an opportunity for settlement of some or all of the issues presented, as well as to facilitate the resolution of issues without the expense of litigation or attorneys` fees for either party.

If a resolution cannot be met between the parties involved, then a hearing before the Workers` Compensation Commission can be requested.

There is a sevenday waiting period before any wage replacement benefits are paid. If your work related injury lasts longer than that time period, then benefits will begin. If the injury keeps you off of work for two weeks or more, then you will receive compensation for the first seven days excluding the day of injury.
In most cases, 662/3% of your average weekly wages will be paid.
