You may choose to have federal tax withheld when benefits are paid. You make the choice when you file your initial claim or at any time during your claim. The federal tax withheld will be withheld at a rate of 10% of the amount you would have received. You will be sent Form 1099&amp;shy;G, by the end of January, which shows unemployment benefits paid to you and any taxes withheld in the previous tax year.       <description>No. Montana is not an "at will" state. In some instances, the Wrongful Discharge From Employment Act does not apply, but generally, once an employee has completed the established probationary period, the employer needs to have good cause for termination. Individuals who believe they were wrongfully discharged must seek civil compensation through the courts, because there is no state agency that administers the Wrongful Discharge From Employment Act.

      <title>When Is Overtime Pay Required?</title>

      <description>Most employees are entitled to be paid time and one&amp;shy;half their regular rate of pay for any time worked over 40 hours in the employer's seven&amp;shy;day workweek. Overtime pay is not required unless an employee actually worked more than 40 hours, so holiday, vacation or sick time does not count towards the 40 hours. There are certain exceptions, however. Agricultural workers are generally exempt from overtime. Executives, administrative, and professionals who are paid on a salary basis are exempt from overtime as are outside sales persons. (Salaried workers who do not meet the definition of executive, administrative, or professional must be paid overtime in addition to their salary.)
