How Is Child Support Determined In Oklahoma?

Child support in Oklahoma is determined by using State support guidelines and a mathematical support software program that takes, among other factors, the following information into consideration:

The gross income of both parents;

The number of children to be supported;

Amount of time each parent spends with the child;

Monthly living expenses of both parents;

Monthly health and dental expenses of both parents;

Monthly child care expenses of both parents; and

Other monthly expenses of both parents.

This information plus any other information required under the law is inserted into a calculation called the Child Support Guidelines and computed to determine the monthly child support obligation that the non custodial parent is ordered to pay. Only a judge can order that child support be paid.

The court may grant a final order in an uncontested divorce that does not involve children, in as little as 10 days after the filing of the initial petition for divorce. If minor children the court shall not issue a final order for at least ninety (90) days from the date of filing the petition. However, the 90 day requirement may be waived by the court for good cause shown and as long as the parties do not object. Please keep in mind that these time frames are assuming that you and your spouse agree on all issues. Should you and your spouse disagree on any issue, then the divorce may take much longer.

What Are The Reasons Behind Child Support In Oklahoma?

Child support is based upon the concept that children are entitled to the support of both parents. This recognizes that there are costs associated with raising children. For example, the custodial parent often has to secure larger living quarters than he/she would otherwise need. The custodial parent may need larger or different transportation, in addition to basic food, clothing, school supplies, medical expenses and so forth. The custodial parent is often paying these things directly. Child support is designed to partially offset these expenses and even out the burden based upon the parent's respective incomes.

What Can I Do If My Spouse Refuses To Pay Support?

You can make your spouse appear before the court. Once there, the judge may find your spouse in contempt of court and your spouse may be put in jail or fined. The judge may issue a wage assignment and garnish your spouse's paycheck. In doing so, then the support payments are taken directly out of your spouse's paycheck. The court may also levy or take your spouse's property such as real estate or bank accounts. In addition, if your spouse fails to pay child support for one year or more or the amount of back support owed is greater than $5,000.00 or your spouse has moved outside of Oklahoma, the District Attorney's Office may file criminal charges.
