What Can I Do To Save My License?

First and foremost, hire an experienced attorney. There are many factors to consider. A good lawyer is absolutely necessary.

Request a hearing and request the officer's presence. It will give you a preview of a trial, a rarity in criminal cases. The officer who signed the notice of hearing may be subpoenaed, and forced to testify before any trial

Consider retest the blood sample. Testing errors may save your license.

Investigate the adequacy of the stop. The officer must have had a reasonable suspicion that a crime or traffic infraction was being committed.

Investigate the adequacy of the arrest and request for a test. The officer must have developed a reasonable belief that you were impaired by alcohol.

Check the times of events. Officers must perform the tests within certain guidelines.

Check the labeling of the sample, and the expiration date of the test vials. It must be identified as being yours, and the seals must be fresh.

Attend the motor vehicle hearing. Listen for fabrications and other errors.

What If I Failed A Breath Test Or A Blood Test?

Talk to a lawyer. These tests are not foolproof. There are many things that can go wrong with a blood test, and many other things that can go wrong with a breath test.

A breath test or a blood test can give a false high reading!

For example: A breath test may be invalid due to an unlicensed or unqualified operator, radio frequency interference, mouth alcohol contamination, internal temperature inaccuracy, etc., etc.

A blood test may be invalid due to unlicensed or unqualified medical personnel doing the blood draw, improper storage and handling of the blood, improper transfer of the blood, malfunctioning test machinery (just like a breath test) etc., etc. Have your case evaluated by an experienced attorney.
