      <title>Should I Take A Breath, Blood Or Urine Test?</title>

      <description>If the officer has a reasonable basis to suspect drugs or alcohol in your body, the officer has the right pursuant to law to require you to submit to a test or tests of the officer's choice.  This test is called the "implied consent."   If the test shows your blood alcohol concentration (BAC) over  0.08, your license will be suspended for 90 days.  You may be eligible for a restricted license for work purposes after the first 30 days of no driving.&#xD;
&#xD;
If you refuse the test, you may be subjected to a blood draw based on a search warrant AND your license will be suspended for one year (called the admin per se suspension). &#xD;

      <title>What Are The Penalties For Aggravated Dui?</title>

&lt;li&gt;(First time felony DUI conviction with NO prior felony convictions) &#xD;
&lt;li&gt;If you are convicted of a class 4 felony as noted above, you will face a possible prison sentence.  Normally, you will receive a grant of probation.  However, if granted probation, the Court is required to incarcerate you in the State Prison for 4 months as a condition of probation.   As a felony, the maximum fine you could face is $150,000.  You will have your license revoked for at least 3 years.   There is no work release.  In addition, the State may forfeit your vehicle.  There are additional penalties within the court's discretion. &#xD;
&lt;li&gt;If you are convicted of a class 6 felony, you will also face the three&amp;shy;year revocation of your driver's license, the same fine as above, and the possibility of incarceration ranging from 4 months to 2 years.&#xD;

      <title>What Is A Dui? There Are Three Basic Types:</title>

      <description>You have committed a basic, misdemeanor DUI in Arizona if you are driving a motor vehicle at a time that your ability to drive the vehicle is impaired by the slightest degree by alcohol, drugs, or any combination.&#xD;

It is also a misdemeanor DUI if you are driving a motor vehicle, regardless of your level of impairment, if your blood alcohol concentration (BAC) is over 0.08.  The BAC is normally scientifically measured by a breath test, blood test, and/or urine test.  The choice of the test or tests is left to the discretion of the police officer. &#xD;
&#xD;
The other normal misdemeanor DUI is a DUI&amp;shy;drug offense.  In this case, there is normally no BAC, and possibly, no bad driving.  Arizona law only requires the prosecutor to prove you were driving with an illegal drug in your system.  &#xD;
