My Vehicle Has Serious Problems. What Should I Do?

You need to report the vehicle`s problems to the dealer or the manufacturer. Check your owner`s manual/warranty booklet for the address and telephone number of the zone office designated to handle your complaint. The booklet will also tell you if the manufacturer requires written notification of a claim requesting a refund or replacement vehicle. If written notification is required, you must write to the manufacturer. Include a copy of your letter to the manufacturer with your Lemon Law application.
IMPORTANT: Keep a record of all contacts with the dealer and manufacturer, along with complete records of all repair work and dates the vehicle was at the dealership. You have the right to a copy of all work orders, even if the work being done is under warranty.

You still may be able to invoke the Lemon Law as long as you can justify that the number of repair attempts or days out of service you encountered were unreasonable.
You may also have other rights under other state and federal laws, such as the following: the federal MagnusonMoss Warranty Act, the Uniform Commercial Code (UCC), your service contract or extended warranty, secret warranties, implied warranties, express warranties, unfair and deceptive acts and practices (UDAP), or strict liability and negligence. Consult an attorney, the South Dakota Office of the Attorney General, or the Center for Auto Safety to determine which remedy would be best for your situation.

What Vehicles Are Covered Under The Lemon Law?

The following table summarizes what is covered and eligibiliy requirements for filing Lemon Law claims.

Vehicles Covered

Repair Intervals and Coverage Period

New motor vehicle (passenger car, combination passenger/commercial van, truck or motorcycle) purchased or leased in the Connecticut which does not conform to the manufacturer`s express warranty and which, after a reasonable number of attempts cannot be repaired so that it does conform to that warranty. The law defines a lemon as a new motor vehicle (passenger car, combination passenger/commercial van, truck or motorcycle) purchased or leased in the Connecticut which does not conform to the manufacturer`s express warranty and which, after a reasonable number of attempts cannot be repaired so that it does conform to that warranty.

4 repair attempts or 30 calendar days out of service.

2 years or 18,000 miles.

Note:

The same problem has to be subjected to a reasonable number of repair attempts and still continue to exist after these attempts at repair.
The law presumes that a reasonable number is four. However, if you have less than four repair attempts for the same problem and can justify that this is a reasonable number of repair attempts, and they have been performed within the time frames noted above.

Or, when the vehicle has been out of service for repair at the dealership for a cumulative total of thirty (30) days or more—not necessarily all at one time—for any number of unrelated problems. These problems must occur within the appropriate time parameters as explained elsewhere in this material.
Or, in the case of a safety defect which is likely to cause death or serious injury if the vehicle is driven, the defect continues to exist after two (2) or more attempts during the first year of operation or the term of the express warranty, whichever occurs first.
These defects must be covered under the manufacturer`s warranty.
A car is out of service while being repaired or waiting for parts.
This is only a summary, to get the complete Lemon Law Statute select your state from the combo box menu on the right side of this page, and click Get Statute.
