Is Pre-Judgment Interest Required?

Prejudgment interest is not allowed in personal injury actions, unless the defendant rejects a formal pretrial demand by the claimant and the judgment is equal to or greater than the demand. In such cases, prejudgment interest is calculated at twelve percent, beginning 30 days after the date of the demand.
