Can A Defendant Who Committs A Sex Crime Be Sentenced More Harshly If They Have Hiv Or An Std?
Wisconsin Statutes Section 969.322 provides that: Maximum term of imprisonment for serious sex crimes may be increased by up to 5 years if all of the following are true: (a) the offender has HIV, an STD, or has tested positive for HIV, (b) the offender knows that he or she has HIV or an STD, and (c) the victim of the serious sex crime was significantly exposed to HIV or STD by the acts constituting the serious sex crime.
