In general, a landlord may choose their tenants freely based on business criteria such as the prospective tenant’s credit history, income, and references. In doing so, a landlord should be consistent in his criteria to rent out the property. The landlord may not discriminate or select the tenant based on other factors such as their race, color, age, religion, national origin, gender, handicap, or familial status. Some states also extend these protections to marital status and sexual orientation.
