Does The Pobar Act Apply If An Officer Is Interrogated By An Outside Agency?
POBAR only covers an officer if his or her commanding officer or any other member of the employing public safety department interviews him or her. An officer who is interrogated by a member of another police agency on a criminal matter is not entitled to protection under the Act. For example, if the FBI or DEA interviews a local cop, the local cop is not covered by POBAR. The officer should consult with his or her union and/or an attorney.
