What Is A Dui? There Are Three Basic Types:

You have committed a basic, misdemeanor DUI in Arizona if you are driving a motor vehicle at a time that your ability to drive the vehicle is impaired by the slightest degree by alcohol, drugs, or any combination. It is also a misdemeanor DUI if you are driving a motor vehicle, regardless of your level of impairment, if your blood alcohol concentration (BAC) is over 0.08. The BAC is normally scientifically measured by a breath test, blood test, and/or urine test. The choice of the test or tests is left to the discretion of the police officer. The other normal misdemeanor DUI is a DUI­drug offense. In this case, there is normally no BAC, and possibly, no bad driving. Arizona law only requires the prosecutor to prove you were driving with an illegal drug in your system. This FAQ was provided courtesy of Howard A. Snader, Attorney at Law.
