Nevada Revised Statutes Annotated Section 441A.300 provides that: A person diagnosed with AIDS who fails to comply with a written order of a health authority, or who engages in behavior through which the disease may be spread to others, is subject to confinement by order of a court.

This is punishable by imprisonment for at least 2 years but not more than 10, or by a fine of not more than $10,000, or by both fine and imprisonment. It is a defense to this offense that the person subject to exposure to HIV knew that the defendant was HIV positive, knew the conduct could result in exposure to HIV, and consented to engage in that conduct.
