What Is An Execution?

Ten days after the entry of judgment, execution may be issued against personal as well as real property pursuant to K.R.S. 426.010. Generally, execution is more successful when the sheriff is given information regarding specific property to be levied against. Although encumbered property can technically be sold, prior lien holders must be included in any judicial sale and as a practical matter judgment creditors may risk substantial out­of­pocket costs associated with a sale in the event that insufficient proceeds are generated to satisfy prior secured or judgment lien creditors.
