What Is The Procedure For Arbitration?

The procedure is relatively simple: courtroom rules of evidence are not strictly applicable; there usually is no motion practice or formal discovery; and there is no requirement for transcripts or the proceedings or for written opinions of the arbitrators. Though there may be no formal discovery, the AAA`s various commercial rules allow the arbitrator to require production of relevant information and documents. The AAA`s rules are flexible and may be varied by mutual agreement of the parties.
