It depends. Under general animal neglect laws, a person who confines a dog or animal is guilty of animal neglect if that person fails to properly provide food, water, and shelter. In addition to proper care, animal neglect protects dogs against anyone who beats or mutilates an animal which causes unjustified pain, distress, or suffering for the animal.
