What happens if a complaint is filed against me with the Michigan Board of Medicine?

When a complaint is filed, the Bureau of Health Professions reviews the allegations. If the allegations are deemed to be within the jurisdiction of the Bureau then the case will move forward to an investigation. The investigation consists of interviews and a gathering of medical records and other relevant documentation. The investigator can make one of three recommendations at the conclusion of his or her investigation. The case can be closed, it can be referred for expert review or it can be transferred for an administrative complaint. If an administrative complaint is filed then the doctor has 30 days to respond to the allegations or sanctions will automatically be imposed. If the state believes that there is an imminent threat to public safety then a summary suspension of the doctor’s license may be imposed. Otherwise, a compliance conference is scheduled so that the parties have an opportunity to reach a settlement. If no settlement is reached or if the settlement is not approved by the Board then an administrative hearing is held. The disciplinary subcommittee reviews the decision from the administrative hearing and decides whether to accept the decision or reverse it.
