Juries in Maine are specifically instructed to consider the comparative negligence of the plaintiff when deciding medical malpractice awards. They are also instructed to specify the exact amount of damages to be paid by each defendant in cases with multiple defendants. That said, the amount of medical malpractice damages is only limited in cases of wrongful death. When a wrongful death has occurred, damages for noneconomic reasons such as pain and suffering are limited to $250,000 and punitive damages are limited to $75,000.
