What happens if a complaint is filed against me with the Florida Department of Health?
If a complaint against a doctor is filed with the Florida Department of Health then the Investigative Services Unit will investigate. Each complaint is assigned to an investigator who collects information from the complainant, the doctor and any other relevant witnesses. An investigative report is then compiled and sent to the Department of Health attorneys for review. The attorneys must make one of four determinations. They can issue an emergency order if there is an immediate safety threat, they can require an expert review of the case, they can close and dismiss the complaint or they can issue an administrative complaint which would have the complaint proceed to a formal hearing. The Board will then take final action in the case.
