In Minnesota, can a Spouse Give Up His or Her Right to Alimony in a Premarital Agreement?

Minnesota statutes are silent on the inclusion of spousal support in premarital agreements. However, Minnesota courts have upheld the modification or elimination of spousal support if the provisions were substantively fair both at the time the agreement was executed and at the time it is enforced.
