What Is Trade Dress?

The laws of unfair trade can protect the overall distinctive look of a business or product. This overall distinctive look is referred to as trade dress. The overall look must be established through nonfunctional characteristics such as color, size, shape, etc. Protection and rights associated with trade dress begin once an acceptable overall distinctive look is achieved, and they last as long as the overall distinctive look is maintained. Trade Dress protection does not require any registration. Infringement occurs when another business significantly copies the overall distinctive look of your business by the use of confusingly similar nonfunctional characteristics.
