What Is Public Domain?

An item that is in the public domain can be used by anyone without violating a copyright, for free.  The simplest way to determine if something is in the public domain is to examine who created the piece of work.  If the piece of work was created by a U.S. Government Employee then it is a piece of the public domain.  Additionally, the copyright owner could donate the copyright to the public, usually with words such as “this work is dedicated to the public and may be reproduced without express authorization.”  Finally, if the copyright has expired, then it may be part of the public domain.  To search for a copyright, you may need to hire an attorney, but there are a few exceptions.  If the work was published before 1923, then their copyrights have expired and they are automatically part of the public domain.  Trying to figure out whether a work is part of the public domain can be complicated and being wrong could be very expensive, it is probably best to consult an attorney who is familiar with copyright law.
