What Is Unique About Pre-Suit Mediation?

Mediation, whether it is conducted pre­or post­suit, is a method for resolving disputes in which a neutral third person trained in the art of dispute resolution helps the parties to a dispute negotiate a settlement. The mediation process is essentially the same regardless of whether it is done before or after a lawsuit has been filed. Since Indiana`s ADR Rules became effective on January 1, 1992, mediation has been widely and successfully used to resolve lawsuits.
