If My Employers Workers Compensation Insurance Is Covering The Costs Of My Work-Related Injury, Can I Still Sue My Employer For My Injuries?

Generally, workers’ compensation statutes will limit an injured employee’s remedies after being injured on the job to benefits from the employer’s workers’ compensation insurance carrier.  Usually, an employee will only be allowed to resort to legal action outside the scope of the workers’ compensation statute if the relationship between the employee and the employer does not fall under the statute’s classification of an employer/employee relationship, or the employee’s injury did not take place during the course of employment.
