Can The State Take My Dog Away From Me?

Yes. Any dangerous dog will be immediately confiscated by the animal control authority if: (1) the dangerous dog does not have a valid registration; (2) the owner does not have valid liability insurance in the event of an injury; (3) the dog is not maintained in a proper enclosure; and (4) the dog is outside of the owner's home and not under the proper physical restraint of the owner or person responsible for the dog. In addition, the dog owner may be guilty of a misdemeanor punishable by any combination of imprisonment in the county jail for a maximum period of one (1) year, a fine not exceeding five thousand dollars ($5,000), and forty (40) hours of community service.
