How Do I Prove Negligence In Court If It Goes That Far?

The burden of proof in a personal injury case as in most civil law cases is lower than the proof required in criminal law cases. In a criminal case, the prosecutor must prove beyond a reasonable doubt that the defendant committed the crime. To win a personal injury lawsuit based on tort law, the plaintiff need only prove that a majority of the evidence shows that an injury was caused by the action of the defendant. The different burdens of proof mean that a person might be acquitted of criminal charges stemming from its actions but be found liable in a civil lawsuit stemming from the same actions.  For example, O.J. Simpson was found not guilty in his criminal case but he was found guilty in the civil case.
