Can A Landlord Charge An Application Fee Separate From The Rent?

Yes. California Civil Code Section 1950.6(b) allows a landlord who conducts a background check to charge a fee to recover those costs. The maximum a landlord can charge is $37.57 and it must be for actual out of pocket costs. If you are charged an application fee you have the right to receive a receipt of the landlord’s costs.
