What is the potential liability in a medical malpractice case in Oregon?
The Oregon Courts have held that limiting the economic and noneconomic damages in a medical malpractice case is unconstitutional. Therefore, no limits are currently in effect for either type of damage award. However, punitive damages are not awarded unless it is found that the defendant acted with malice or that the defendant acted outside the scope of his duties.
