What is the potential liability in a medical malpractice case in Idaho?
Actual economic losses, such as medical bills and loss of income, are recoverable from a defendant if a plaintiff is successful in his or her medical malpractice case. A plaintiff may also recover up to approximately $250,000 in noneconomic damages, such as those for pain and suffering and loss of enjoyment. The $250,000 limit is adjusted annually according to the state’s average wage. Punitive damages are also limited to $250,000 or three times the amount of compensatory damages awarded in the case.
