How Are Prior Convictions Calculated?
Convictions incurred prior to July 1, 1991 may not be used for computing prior convictions. If there are 5 or more years between the first and the subsequent conviction, the first conviction will not be counted. If there are 15 years or more between any prior and subsequent conviction, the prior conviction will not be counted. These forgiveness periods do not apply to convictions incurred after July 1, 1991. Vermont counts outofstate DUI or DWI convictions for computing the number of offenses. 23 V.S.A. §1211.
