Why Am I Being Charged With Two Crimes?

The traditional offense is "operating under the influence of liquor" (OUIL). In recent years, however, many states have also enacted a second, so­called "per se" or UBAL offense: driving with an unlawful blood­alcohol level (.10 in Michigan). When both offenses are charged, the defendant cannot be convicted of both; either one or the other, something lesser, or nothing.
