Is A Prostitute With Hiv Subject To A Harsher Sentence?
A: Utah Code Annotated Section 76-10-1309 provides that: A person who is convicted of prostitution, patronizing a prostitute, or sexual solicitation is guilty of a third degree felony if he or she: (1) is HIV positive, (2) has actual knowledge of his or her HIV positive status, and (3) has received written personal notice of the positive test result from a law enforcement agency.
