New York Terminations and Evictions Forms

• Suffolk County District Court Complaint Form
  This complaint is filed by the landlord in an eviction action alleging that tenant breached the lease agreement or failed to pay rent.
• Affidavit in Support of Motion to Vacate Default Judgment (Landlord-Tenant)
  This affidavit is filed by the tenant after a default judgment in an eviction action has been entered against the tenant.
• Landlord Tenant Order to Show Cause
  This order is entered by the court and must be served upon the opposing party in an eviction action.
• Affidavit in Support of an Application to Proceed as a Poor Person and to Waive Court Fees
  A party fills this form asking the court to waive court fees because he or she does not have or is not able to obtain the fees and will not be able to proceed unless the court grants the application.
• Affidavit of Military Investigation
  This affidavit is sworn to by someone not a party stating that the respondent in the action is not currently in military service or a dependent of someone in military service.
• Notice of Entry
  This notice informs the parties that a judgment/order was entered in the landlord/tenant office of the Clerk of Civil Court of the City of New York.

  This form is filled out when a tenant comes before the court and answers a petition in eviction orally.
