Can I file a lawsuit for having a faulty defibrillator?

Yes. Initially, Guidant indicated they would not cover the recall defibrillator replacements of more than five years old since they are off-warranty, but on the heels of the recent deaths attributed to the faulty defibrillators, Guidant has since changed their position. In fact, with the costs estimated at $25,000 per unit for each replacement defibrillator, Guidant could be facing compensation costs of as much as $225 million.
