What are the Residency and Filing Requirements for Divorce in Virginia?

Virginia divorce petitions should be filed in circuit court. (Code of Virginia Title 20 Domestic Relations Chapter 6 Divorce Affirmation and Annulment Section 96)  A divorce complaint may be brought if either party has resided in Virginia, in good faith, for at least 6 months prior to filing for divorce. (Code of Virginia Title 20 Domestic Relations Chapter 6 Divorce Affirmation and Annulment Section 97)
