Why do I need a QDRO prepared by an attorney? The retirement plan sent me a model QDRO.
The rules governing QDROs and retirement plans are complex and constantly changing. Although the model is often a good starting point, it does not necessarily address all the issues contemplated in the marital settlement agreement. The model usually provides several choices which are written in legalese that Plan participants may have difficulty understanding. Because the pension often represents a significant asset, it is important for you to understand the choice you are making and an attorney can help you make choices that are in your best interest. Also a QDRO must contain certain information contained in the Employee Retirement Income Security Act and the Internal Revenue code that an attorney will be more familiar with.
